For purposes of these Terms, (a) “we” and its derivatives means Qualtrics, LLC and (b) “you” and its derivatives means you and the entity you represent and also refers to any person accessing the community website provided by us (“Community”) by any method on your behalf. You agree that you will not:- use this community to post any material which is knowingly false and/or defamatory;- post any content which, in our sole discretion, is inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violates any law;- post any copyrighted material unless the copyright is owned by you;impersonate any other person;- falsely say or imply that you are associated with is, another person or entity;violate any anti-spam or similar law;- use the Community to store or transmit malicious code or malware, or to engage in phishing or other fraudulent activity;- scrape, data extract or data mine, or any related activity, from the Community.We also reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message posted by you. We log all internet protocol addresses accessing the Community.Use of the Community is at your option, is completely voluntary, is not required to use the Qualtrics products, and at your sole risk. We may modify the functionality of the Community and its interface at any time at our sole discretion. Qualtrics uses the services of a third-party to provide the Community. Your Qualtrics user information (not your password) will be sent to the third-party for purposes of authenticating to the Community platform.We own all right, title, and interest in and to all suggestions, ideas, enhancements, requests, feedback, and recommendations provided by you to Qualtrics.We reserve the right to remove or refuse to post any content for any reason or no reason at all. We reserve the right to terminate any membership for any reason or no reason at all. You grant to us a perpetual, worldwide, fully paid up right and license to use, copy, modify, publish, republish, distribute and create derivative works based on, in any form, any content or material you contribute to the Community. Subject to the limited rights expressly granted hereunder, we reserve all rights, title and interest in and to all intellectual property rights in the Community, including but not limited to its user interface, branding, content, ideas, and underlying technology. No rights are granted to you hereunder other than as expressly set forth herein.
THE COMMUNITY IS PROVIDED “AS-IS,” EXCLUSIVE OF ANY EXPRESS OR IMPLIED WARRANTIES WHATSOEVER. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE ARE NOT RESPONSIBLE FOR ANY CONTENT POSTED BY YOU OR ANY THIRD PARTY, WHETHER OR NOT WE REVIEWED OR MODERATED SUCH CONTENT. CONTENT POSTED BY US ON THE COMMUNITY ARE NOT PART OF ANY ONLINE INFORMATION, DOCUMENTATION OR LEGAL AGREEMENT. ALL SUCH CONTENT IS PROVIDED “AS-IS”, AND WE DO NOT MAKE ANY REPRESENTATION AS TO ITS QUALITY OR ACCURACY, AND WE SPECIFICALLY DISCLAIM THE ACCURACY, COMPLETENESS, RELIABILITY, USEFULNESS, NON-INFRINGEMENT, QUALITY OR ORIGINALITY OF SUCH CONTENT. WE DISCLAIM ANY RESPONSIBILITY FOR ANY CONTENT OR MATERIAL ON THE COMMUNITY REGARDLESS OF WHO ORIGINATED THAT CONTENT (INCLUDING OUR EMPLOYEES, PARTNERS, AFFILIATES OR MODERATORS).
You agree that you bear all risks associated with using or relying upon content on the Community. IN NO EVENT SHALL WE HAVE ANY LIABILITY HEREUNDER TO YOU FOR ANY LOSSES OR DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR DAMAGES BASED ON LOST PROFITS, DATA OR USE, HOWEVER CAUSED AND, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, WHETHER OR NOT YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Marketing. Qualtrics may use your Personal Data to inform you about Qualtrics’ latest products, service offers, and events. Any such use of information is based on the consent you grant hereunder. Qualtrics may use your name, email, and postal address, telephone number, job title, and basic information about your employer (name, address, and industry), as well as an interaction profile based on prior interactions with Qualtrics (prior purchases, participation in webinars, seminars or events, or the use of (web) services in order to keep you up to date on the latest product announcements, software updates, software upgrades, special offers, and other information about Qualtrics or SAP Group’s software and services (including marketing-related newsletters) as well as events of Qualtrics or SAP Group and in order to display relevant content on Qualtrics or its affiliates websites. In connection with these marketing-related activities, Qualtrics will provide a hashed user ID to third-party operated social networks or other web offerings (such as Twitter, LinkedIn, Facebook, Instagram or Google) where this information is then matched against the social networks’ data or the web offerings’ own databases in order to display to you more relevant information. Qualtrics XM Community Rank and Rewards program: Not all geographical locations or Qualtrics license holders may be eligible. Qualtrics reserves the right to change or modify the rules and eligibility for the Rank and Rewards program at any time, without notice. AT THIS TIME, THE FOLLOWING GEOGRAPHIC REGIONS ARE EXCLUDED FROM RANK AND REWARDS: INDIA (only official Qualtrics partners and resellers may participate in the Rank & Rewards program. Community members in India who are NOT part of the official Qualtrics Partner Network may NOT participate in Rank & Rewards). Note: XM Community members are not allowed to leverage AI such as Chat GPT to respond to or generate content on the XM Community. Members who continue using AI to create content may be suspended or banned from the XM Community. The XM Community admins reserve the right to exercise final judgment on whether or not users’ contributions and content represent good faith efforts to contribute to the XM Community.
