How can I combine file upload question and multiple choice question with single validation

I'd like to show a file upload question and include a tickbox below for something like 'I don't have any files to upload', ensuring that there is a validation across each so that respondent must either upload or tick the box before progressing. Any help on code would be appreciated.

Have you considered setting this up with two different questions and using Custom Validation? See screen shots below.
