When creating a new survey with a web service can it be automatically "Active" instead of "New"

Hi - we use web service APIs to create new surveys like a request board.
A user fills out a survey and based on their selections it creates a new survey and collaborates it with them via web service API. However, if we want another user to take that newly created survey via an anonymous link its status is "New" so the anonymous link returns an error because its not "Active". We want the survey to be instantly "Active" so the user who creates it does not need to publish it.
One way around this is distributing the preview link however we want the users who fill out this survey not to have the preview features.
